    Yo sé muy bien que las opciones que brindan los distintos sitios de imágenes gratis para uso en internet, son pocas. A veces recorremos una y otra vez sitios como Pixabay.com, Unsplash.com, Pexels.com y cualquier otr de nuestra preferencia y vemos imágenes que ya han sido publicadas muchas veces en otros post, ya sean nuestros o de usuarios a los que seguimos en Hive.

    También se da el caso en el que tratamos de temáticas tan concretas que es imposible conseguir allí las imágenes relacionadas.

    En muchos de estos casos optamos por buscar alternativas y muchas personas recurren a un sitio en el que siempre se pueden encontrar fotos para lo que buscamos: Pinteres.com.

    ¿Pero estamos actuando correctamente? ¿Nos oferece Pinterest imágenes libres de derecho de autor? ¿Corremos el riesgo de una demanda al usar imágenes de allí? ¿Vamos a recibir el apoyo de las comunidades de curación usando estas imágenes?

    Si no estás muy familiarizado con el tema de la necesidad de colocar la fuente de las imágenes en tus posts, te invito a leer primero La fuente de una imagen ¿Cómo colocarla y por qué?.

    Una de las razones principales para hacer esto, es para indicarles a los curadores de dónde proviene la misma y que lo puedo constatar en el enlace. De esta manera el curador puede tener la certeza de que se trata de imágenes de libre derecho de uso, es decir que no son imágenes que cuentan con un ©Copyrigt o derechos de autor.

    Esa certeza solo la podemos tener si la fuente proviene de un sitio que expresamente lo diga, que tenga escrito expresamente que las imágenes se pueden usar con fines comerciales (pues recuerda que acá estás monetizando tu contenido).

    ¿Pero cuál es la característica de Pinterest?

    Lo primero que hay que entender es para qué fue creada esa aplicación y qué dice su reglamento.

    El objetivo de Pinterest es ofercerte un pizarra digital para que tú colecciones imágenes que puedas servirte de fuente de inspiración, como recordatorio, ideas para proyectos, etc.

    Por lo tanto, lo primero que debes hacer para poder usar esa plataforma es crear tu cuenta y "aceptar sus condiciones".

    Esos dos pasos son los que liberan a Pinterest de un uso indebido de la plataforma y te transfieren a ti la responsabilidad por lo que tu "pineas" allí, es decir, por las imágenes que tú guardas en tu pizarra virtual.

    Entre las reglas que tú aceptas al abrir tu cuenta está que tú dices tener derecho de uso sobre las imágenes. Por lo tanto, si no lo tienes y se presenta alguna demanda, el único responsable eres tú...

    Pero además, la idea es que tú aceptas toda una cantidad de condiciones que rigen para el uso en esa plataforma puntualmente. Dado que allí están presentes muchas empresas interesadas en que le des promoción a sus productos, ellos no hacen problema por el hecho de usarlos allí. Y es posible que en Pinterest un autor acepte que uses sus imágenes, aunque estas sean sujeto del derecho de autor. Pero insisto, eso es a nivel interno, en tu pizarra de Pinterest. En el momento que tú publicas esa misma imagen en otra plataforma, como pudiera ser el caso de Hive, ya cambia el panorama y quedas expuesto a cualquier tipo de reclamo o demanda.

    Pero lo peor del caso es que la mayoría de las personas que colocan imágenes de Pinterest, ni siquiera están tomando imágenes de su propia pizarra, sino que utilizan imágenes pineadas por cualquier persona y se limitan a colocar un enlace a dicho sitio, violando no solo los derechos de la persona que creó su pizarra, sino toda lógica.

    Afortunadamente, hasta ahora yo no he sabido de ninguna demanda establecida contra ningún usuario de Hive por violación de derechos de autor, con respecto a imágenes. Pero en gran parte eso se debe a la campaña constante para evitar que se caiga en ese ilícito.

    Por lo tanto, NO es aconsejable usar imágenes tomadas de Pinteres, porque no sabemos si son libres de derecho de uso o no y en caso tal, seremos nosotros los que estemos usurpando unos derechos que no tenemos.

    Aunque hoy en día es una práctica muy común el uso de imágenes con derechos de autor, es necesario contribuir a que las cosas en el mundo se hagan correctamente. Es por esa misma razón que cada vez más las cmunidades y los curadores están pendientes de la adecuada indicación de la fuente de cada imagen y que esta sea en realidad de libre uso.

    But are we acting correctly? Does Pinterest offer us copyright-free images? Do we run the risk of a lawsuit by using images from there? Are we going to receive support from curation communities using these images?

    If you are not very familiar with the topic of the need to place the source of the images in your posts, I invite you to do a search on the internet, as the this task is the first step to making a post the right way.

    One of the main reasons for doing this is to indicate to the curators where the image comes from and that he/she can check it in the link. This way the curator can be sure that the images are free to use, that is to say that they are not ©copyrighted images.

    This certainty can only be obtained if the source comes from a site that expressly says so, that has expressly written that the images can be used for commercial purposes (remember that here you are monetizing your content).

    But what is the feature of Pinterest?

    The first thing to understand is what this application was created for and what its regulations say.

    Pinterest's objective is to offer you a digital board for you to collect images that can serve as a source of inspiration, as a reminder, ideas for projects, etc.

    Therefore, the first thing you must do to use this platform is to create your account and "accept its conditions".

    These two steps are the ones that free Pinterest from misuse of the platform and transfer to you the responsibility for what you "pin" there, that is, for the images you save on your virtual board.

    Among the rules that you accept when you open your account is that you claim to have the right to use the images. Therefore, if you don't have it and a lawsuit is filed, you are the only one responsible...

    But also, the idea is that you accept a whole set of conditions that govern the use on that platform. Since there are many companies there that are interested in you promoting their products, they don't make it a problem to use them there. And it is possible that on Pinterest an author accepts that you use their images, even if they are subject to copyright. But I insist, that's internally, on your Pinterest board. The moment you publish that same image on another platform, as could be the case of Hive, the picture changes and you are exposed to any kind of claim or lawsuit.

    But the worst part of the case is that most people who post images from Pinterest, are not even taking images from their own board, but use images pinned by anyone and just post a link to that site, violating not only the rights of the person who created their board, but all logic.

    Fortunately, so far I have not known of any lawsuit established against any Hive user for copyright infringement, with respect to images. But in large part that is due to the constant campaign to avoid falling into such wrongdoing.

    Therefore, it is NOT advisable to use images taken from Pinterest, because we do not know if they are free of copyright or not and if so, we will be the ones who are usurping rights that we do not have.

    Although nowadays it is a very common practice to use copyrighted images, it is necessary to contribute to doing things in the world correctly. It is for this very reason that more and more communities and curators are watching for the proper indication of the source of each image and that it is in fact free to use.
